Can foreigners buy a property in Malta?




According to Chapter 246 of the Laws of Malta, individuals who have lived in Malta continuously for a minimum of five years at any time before the acquisition date, they are free to buy any immovable property without having to get a permit from the Commissioner for Revenue.


On the other hand, individuals who have not lived in Malta for at least a continuous period of five years, can only buy a primary residence or business property without having to obtain a permit from the Commissioner of Revenue. Indeed, if such citizens wish to purchase a secondary residence then they will require a permit issued by the Commissioner for Revenue specifically for this purpose.

Moreover, individuals who are not citizens of the EU Member states are not able to buy any immovable property unless they are granted a special permit that is the AIP (Acquisition of Immoveable Property) Permit. The Notary will in such instance submit an application for this purpose with the Commissioner for Revenue and follows up on the said application. Once permit is approved the individual will be able to acquire the immoveable property.


It is important to note that some defined areas in Malta, referred to as special designated areas (examples of such are Fort Chambray, areas in Madliena, Tigne Point and more) have no limitations on acquisition whatsoever.
