After marriage, all civil obligations and/or actions such as taking a loan and acquiring immoveable property, performed by either of the spouses alone will effect both spouses. This means that the action taken will be seen as if done by both spouses acting together in equal portions, even if the said actions are done without the consent of the other spouse.
This happens because in Malta the matrimonial regime that regulates marriages is the COMMUNITY OF ACQUESTS. It is possible that this regime is excluded by the couple before marriage, in virtue of a prenuptial agreement or else after marriage, in virtue of a separation of estates.
