In order to establish the right to an agency fee, certain conditions must be fulfilled. Firstly, there should be a prospective conclusion of a business transaction. Additionally, both parties involved must have either requested or accepted the introduction of the agency. Finally, the agent/agency's activities should have resulted in the parties reaching a mutual consensus or agreement.
If any of these elements are missing, a claim for the right to an agency fee cannot be substantiated. Nevertheless, compensation may still be considered for the services rendered by the agency/agent.
