Użufrutt huwa kunċett legali li għandu għeruqu fl-istorja, li jiddefinixxi d-dritt temporanju li tuża u tgawdi ż- proprjetà ta’ persuna oħra mingħajr sjieda. Derivat mill-kliem Latin "usus" (użu) u "fructus" (frott jew benefiċċji), użufrutt jipprovdi lill-individwi bi drittijiet speċifiċi fuq proprjetà, ħafna drabi għal perjodu definit jew taħt ċerti kundizzjonijiet.
Karatteristiċi Ewlenin:
- Tgawdija Temporanja: Użufrutt jagħti lid-detentur id-dritt li juża u jieħu benefiċċji minn proprjetà, iżda mhux li jeqred jew jibdel in-natura essenzjali tiegħu. Dan huwa arranġament temporanju, u t-tul huwa tipikament speċifikat fi ftehimiet legali.
- Nuqqas ta' Sjieda: B'mod kruċjali, użufrutt ma jittrasferixxix is-sjieda. Is-sid iżomm iż- titolu u jista’ jieħu lura l-kontroll sħiħ taż- proprjetà ladarba jiskadu d-drittijiet tal-użufruttwarju.
