What properties and earnings are considered to be owned jointly by the spouses?

Liema proprjetajiet u qligħ huma kkunsidrati bħala proprjetà konġunta tal-konjuġi?

Article 1320 of the Maltese Civil Code provides that a married couple who has the Community of Acquests regulating their matrimonial regime states that the following will become owned by both spouses jointly and in equal portions:

• All that is acquired by the spouses through their work or profession;
• All earnings arising from property owned by spouses. In this case it is important to note that if the property has been transferred to either of the spouses for example through a donation from his/her parents, and this with the express condition that proceeds made out of the use of that property does not become part of the community of acquests, then such money remains property of the spouse and does not enter the community;
• The earnings made from property owned by the children;
• Any property which is acquired with money or other property which is already in the community of acquests, even if the property is in the name of only one spouse;
• Property acquired after marriage by personal property of the spouses;
• Any fortuitous winnings by either of the spouses;

L-Artikolu 1320 tal-Kodiċi Ċivili Malti jipprovdi li koppja miżżewġa li għandha ż- Komunjoni tal-akkwisti li tirregola r-reġim matrimonjali tagħhom tgħid li dawn iż- testment li ġejjin isiru proprjetà taż-żewġ konjuġi flimkien u f’porzjonijiet indaqs:

• Dak kollu akkwistat mill-konjuġi permezz tax-xogħol jew professjoni tagħhom;
• Il-qligħ kollu li ġej minn proprjetà proprjetà tal-konjuġi. F’dan il-każ huwa importanti li wieħed jinnota li jekk iż- proprjetà tkun ġiet trasferita lil xi wieħed mill-konjuġi pereżempju permezz ta’ donazzjoni mingħand il-ġenituri tiegħu/tagħha, u dan bil-kundizzjoni espressa li d-dħul magħmul mill-użu ta’ dik iż- proprjetà ma jsirx parti miż- komunjoni tal-akkwisti, allura dawn il-flus jibqgħu proprjetà taż-zq5 u ma jidħlux fil-komunità;
• Il-qligħ magħmul minn proprjetà proprjetà tat-tfal;
• Kwalunkwe proprjetà li tkun akkwistata bil-flus jew proprjetà oħra li tkun diġà fiż- komunjoni tal-akkwisti, anke jekk iż- proprjetà ikun f'isem konjuġi wieħed biss;
• Proprjetà miksuba wara żwieġ minn proprjetà personali tal-miżżewġin;
• Kwalunkwe rebħ fortuwit minn xi wieħed mill-konjuġi;
